The Johnson & Johnson Diabetes Institute, LLC is concerned about privacy issues and wants you to be familiar with how we collect, use, and disclose information. This Privacy Policy describes our practices in connection with information that we or our service providers collect through the Web site or Web property (including, for example, a mobile Web site or application) operated and controlled by us from which you are accessing this Privacy Policy (each, the “Site”). Information You Provide

Some areas of the Site may ask you to submit personal information in order for you to benefit from the specified features (such as newsletter subscriptions, tips/pointers, or order processing) or to participate in a particular activity (such as sweepstakes or other promotions). You will be informed what information is required and what information is optional.

We may combine the information you submit with other information we have collected from you, whether on- or offline, including, for example, your purchase history. We may also combine it with information we receive about you from other sources, such as other Johnson & Johnson Operating Companies, publicly available information sources (including information from your publicly available social media profiles), and other third parties.

Passive Information Collection and Use

As you navigate around the Site, certain information can be passively collected (that is, gathered without your actively providing the information), using various technologies. We and our third party service providers passively collect and use information in a variety of ways, including:

Through your browser: Certain information is collected by most browsers, such as your Media Access Control (MAC) address, computer type (Windows or Macintosh), screen resolution, operating system version, and Internet browser type and version. We may collect similar information, such as your device type and identifier, if you access the Site through a mobile device.

Using cookies: Cookies are pieces of information stored directly on the computer you are using. Cookies allow us to collect information such as browser type, time spent on the Site, pages visited, and language preferences. We and our service providers use the information for security purposes, to facilitate navigation, display information more effectively, and to personalize your experience while using the Site. We also use cookies to recognize your computer or device, which makes your use of the Site easier, such as to remember what is in your shopping cart. In addition, we use cookies to gather statistical information about Site usage in order to continually improve its design and functionality, understand how individuals use it, and to assist us with resolving questions regarding it. Cookies further allow us to select which of our advertisements or offers are most likely to appeal to you and display them while you are on the Site. We may also use cookies in online advertising to track consumer responses to our advertisements.

Using Flash cookies: Our use of Adobe Flash technology (including Flash Local Stored Objects (“Flash LSOs”)) allows us to, among other things, serve you with more tailored information, facilitate your ongoing access to and use of the Site, and collect and store information about your use of the Site. If you do not want Flash LSOs stored on your computer, you can adjust the settings of your Flash player to block Flash LSO storage using the tools contained in the Website Storage Settings Panel. Using pixel tags, web beacons, clear GIFs, or other similar technologies: These may be used in connection with some Site pages and HTML-formatted e-mail messages to, among other things, track the actions of Site users and e-mail recipients, measure the success of our marketing campaigns, and compile statistics about Site usage and response rates.

Online behavioral advertising: The use of cookies, pixel tags, web beacons, clear GIFs, or other similar technologies allows our third-party vendors to deliver advertisements about our products and services when you visit the Site or other web sites or web properties across the Internet. These vendors may place pixel tags, web beacons, clear GIFs, or similar technologies on the Site and other websites or web properties, and also place or recognize third-party cookies when you visit the Site or other sites or web properties. They may use information about your visits to the Site and other web sites or web properties to provide advertisements about goods and services that may be of interest to you.

IP Address: Your IP Address is a number that is automatically assigned to the computer that you are using by your Internet Service Provider. An IP Address is identified and logged automatically in our server log files whenever a user visits the Site, along with the time of the visit and the page(s) that were visited. Collecting IP Addresses is standard practice on the Internet and is done automatically by many web sites. We use IP Addresses for purposes such as calculating Site usage levels, helping diagnose server problems, and administering the Site.

Device Information: We may collect information about your mobile device, such as a unique device identifier.

How We Use and Disclose Information

We use and disclose information you provide to us as described to you at the point of collection.

We also use information from or about you:

  • to respond to your inquiries and fulfill your requests, such as to send you documents you request or e-mail alerts;
  • to send you important information regarding our relationship with you or regarding the Site, changes to our terms, conditions, and policies and/or other administrative information; and
  • for our business purposes, such as data analysis, audits, developing new products, enhancing our website, improving our products and services, identifying Site usage trends, personalizing your experience on the Site by presenting products and offers tailored to you, and determining the effectiveness of our promotional campaigns.

We also disclose information collected through the Site:

  • to our affiliates for the purposes described in this Privacy Policy. A list of our affiliates is available here (click on the link for Form 10K, Exhibit 21, under “SEC Filings”). The Johnson & Johnson Diabetes Institute, LLC is the party responsible for the management of the jointly-used Personal Information;
  • to our third party partners with whom we offer a co-branded or co-marketed promotion;
  • to our third party service providers who provide services such as website hosting and moderating, mobile application hosting, data analysis, payment processing, order fulfillment, infrastructure provision, IT services, customer service, e-mail and direct mail delivery services, credit card processing, auditing services, and other services, in order to enable them to provide services; and
  • to a third party in the event of any reorganization, merger, sale, joint venture, assignment, transfer, or other disposition of all or any portion of our business, assets, or stock (including in connection with any bankruptcy or similar proceedings).

In addition, we use and disclose information collected through the Site as we believe to be necessary or appropriate: (a) as permitted by applicable law, including laws outside your country of residence; (b) to comply with legal process; (c) to respond to requests from public and government authorities, including public and government authorities outside your country of residence; (d) to enforce our terms and conditions; (e) to protect our operations or those of any of our affiliates; (f) to protect our rights, privacy, safety, or property, and/or that of our affiliates, you, or others; and (g) to allow us to pursue available remedies or limit the damages that we may sustain. We may also use and disclose information collected through the Site in other ways, with your consent

We also use and disclose information we collect passively as described above, under “Passive Information Collection and Use,” and for any other purpose, except where we are required to do otherwise under applicable law (for example, if we are required to treat such information as personal information). In addition, we may use and disclose information that is not in personally identifiable form for any purpose. If we combine information that is not in personally identifiable form with information that is (such as combining your name with your geographical location), we will treat the combined information as personal information as long as it is combined.

THIRD PARTY SITES AND SERVICES

This Privacy Policy does not address, and we are not responsible for, the privacy, information, or other practices of any third parties, including any third party operating any site or web property (including, without limitation, any application) that is available through this Site or to which this Site contains a link. The availability of, or inclusion of a link to, any such site or property on the Site does not imply endorsement of it by us or by our affiliates.

SECURITY

We use reasonable organizational, technical, and administrative measures to protect personal information under our control. Unfortunately, no data transmission over the Internet or data storage system can be guaranteed to be 100% secure. If you have reason to believe that your interaction with us is no longer secure (for example, if you feel that the security of any account you have with us has been compromised), please immediately notify us of the problem by contacting us in accordance with the “Contacting Us” section below

CHOICES AND ACCESS

Your choices regarding our use and disclosure of your personal information

We give you choices regarding our use and disclosure of your personal information for marketing purposes. You may opt out from:

  • Receiving marketing communications from us: If you no longer want to receive marketing communications from us on a going-forward basis, you may opt out of receiving them by contacting us via email at info@jjdi.us. In your response to us, please provide your name, identify the form(s) of marketing communications that you no longer wish to receive, and include the address(es) to which it/they are sent. For example, if you no longer wish to receive marketing e-mails or direct mail from us, tell us that, and provide your name and e-mail or postal address. You may also opt out of receiving communications from us by logging into jjdi.com to update your online profile.
  • Our sharing of your personal information with affiliates and third-party partners: If you would prefer that we not share your personal information on a going-forward basis with our affiliates and/or third-party partners for their marketing purposes, you may opt out of this sharing by contacting us at info@jjdi.us. In your response to us, please state that we should no longer share your personal information with our affiliates and/or third-party partners for their marketing purposes, and include your name and e-mail address.

We will seek to comply with your request(s) as soon as reasonably practicable. Please note that if you opt out as described above, we will not be able to remove your personal information from the databases of our affiliates with which we have already shared your information (i.e., as of the date that we implement your opt-out request). Please also note that if you opt out of receiving marketing-related messages from us, we may still send you important transactional and administrative messages, from which you cannot opt out.

How you can access, change, or delete your personal information

If you would like to review, correct, update, or delete the personal information that you have provided via the Site, please edit your profile by logging into jjdi.com and selecting “edit profile.” You may also contact us via info@jjdi.us. We will try to comply with your request as soon as reasonably practicable.

RETENTION PERIOD

We retain your personal information for the period necessary to fulfill the purposes outlined in this Privacy Policy, unless a longer retention period is required or allowed by law or to otherwise fulfill a legal obligation.

USE OF SITE BY MINORS

The Site is not directed to individuals under the age of 13, and we request that these individuals not provide Personal Information through the Site.

CROSS-BORDER TRANSFER

Your personal information may be stored and processed in any country where we have facilities or service providers, and by using our Site or by providing consent to us (where required by law), you agree to the transfer of information to countries outside of your country of residence, including to the United States, which may provide for different data protection rules than in your country.

SENSITIVE INFORMATION

Unless we specifically request or invite it, we ask that you not send us, and you not disclose, any sensitive personal information (e.g., information related to racial or ethnic origin, political opinions, religion or other beliefs, health, criminal background or trade union membership) on or through the Site or otherwise to us. In those cases where we may request or invite you to provide sensitive information, we will do so with your express consent.

UPDATES TO THIS PRIVACY POLICY

We may change this Privacy Policy. Please take a look at the “LAST UPDATED” legend at the top of this page to see when this Privacy Policy was last revised. Any changes to this Privacy Policy will become effective when we post the revised Privacy Policy on the Site. Your use of the Site following these changes means that you accept the revised Privacy Policy.

Terms and Conditions

The Member Search is a service to enable registered members of the community, which include faculty and graduates of the Johnson & Johnson Diabetes Institute, as well as other licensed healthcare professionals, to find and connect with each other. In the course of using the Member Search, members provide information about themselves and determine what information will be visible to others (see our Privacy Policy to learn more). The terms and conditions apply solely to the Member Search service; in addition; Member Search is also subject to the Johnson & Johnson Diabetes Institute Legal Notice and Privacy Policy.

The Johnson & Johnson Diabetes Institute Community is not a medical provider or provider of any services other than the Message Board and the Member Search. We do not endorse or recommend the products or services of any particular health care provider or evaluate or determine your or your patients’ need for any particular product, service or information. We do not give individual medical, therapeutic or other medical-related advice or advocate any particular treatment or course of treatments, diagnosis, cure, therapy or other related product or service for any individual patient or practitioner.

You understand that all information publicly posted or privately transmitted through the Member Community is the sole responsibility of the person from whom such content originated and that the Johnson & Johnson Diabetes Institute will not be liable for any errors or omissions in any content. You understand and agree that you will evaluate, and bear all risks associated with, the use of any content, including any reliance on the accuracy, completeness, or usefulness of such content.

You further acknowledge and agree that, beyond providing and facilitating Member Community, the Johnson & Johnson Diabetes Institute has no control over or oversight of, and will not participate or otherwise be involved in, your dealings with any other Member. Any outside communications, transactions or other dealings that you may have or enter into with any other user of Member Community are solely between you and such other user.

The Member profile is used to tailor content (online and offline), and as a way to search for other members of the community with similar backgrounds, patient populations, and professional interests. Members (and faculty) can conduct searches and invite colleagues to join their "community"—a personal network of invited Johnson & Johnson Diabetes Institute registered Members. You do not have to accept another Member’s invitation to join their network, and users are only allowed to send two invitations to the same person; if the person does not respond, you cannot pursue the connection further through the Member Community.

You can access, check, update, change and delete your Member Profile at any time by logging in to the Johnson & Johnson Diabetes Institute Member Center and choosing to "Edit My Profile." Please be sure before deleting your profile, as your access to the Center —and your invited Community—will also be removed. Re-entry into the Johnson & Johnson Institute Center will require re-registration.

User Conduct

You agree not to use the Community to:

  • Falsely state, impersonate, or otherwise misrepresent your identity, including but not limited to the use of a pseudonym, or misrepresenting your current or previous positions and qualifications, or your affiliations.
  • Pursue any illegal purpose, including but not limited to conspiring to violate any applicable laws or regulations.
  • Initiate communications that include information that you do not have the right to disclose or make available (such as personally identifiable patient information, or confidential information learned under nondisclosure agreements).
  • Harass or stalk anyone, including but not limited to not pursuing a member that has refused an invitation to connect with you. You can request connections with members up to two times. If both invitations are denied, you may no longer request a connection with that member.
  • Make available any unsolicited or unauthorized advertising, promotional materials, "junk mail," "spam," "chain letters," "pyramid schemes," or any other form of solicitation. This prohibition includes but is not limited to a) Sending unsolicited promotional messages and b) Sending messages to distribution lists, newsgroup aliases, or group aliases.

You agree that you have read and are familiar with these User Conduct Guidelines. Please note that users who violate our User
Conduct Guidelines may have messages removed and if necessary, may have access to the site restricted or denied. You
understand and agree that all text, graphics, software, music, sound, photographs, videos, messages, posts, data, information,
or other materials (collectively, the "Content") is the sole responsibility of the person with whom the Content originated. You are
responsible for all Content that you disseminate or transmit through or by means of the Web site. You agree not to:

  • Post, disseminate, or transmit any Content that includes or promotes an “off-label” or unapproved use of a drug, device or other medical product;
  • Post any patient’s personally identifiable information if you are a health care provider;

  • Post, disseminate, or transmit any Content that infringes or violates any party's copyright, trademark, trade secret, patent, or other proprietary right, including, but not limited to, using third-party copyrighted materials without appropriate permission or attribution, using third-party trademarks without appropriate permission or attribution, and using or distributing third-party information (whether or not protected as a trade secret) in violation of a duty of confidentiality;
  • Post, disseminate, or transmit any worms, viruses, or other harmful, disruptive, or destructive files, code, or programs;
  • Post, disseminate, or transmit any advertising, promotional materials, chain letters, spam, junk mail, or any other type of unsolicited mass e-mail to people or entities that have not agreed to be part of such mailings;
  • Impersonate any person or entity; falsely state or otherwise misrepresent your affiliation with any person or entity; intentionally omit, delete, forge, or misrepresent transmission information, including headers, return mailing, and Internet protocol addresses; or otherwise manipulate identifiers to disguise the origin of any Content transmitted through the Web site;
  • Interfere with, disrupt, or harm in any way the Web site or servers or networks connected to the Web site;
  • Attack the character or damage the reputation of other members, name-call, insult, ridicule, mock, electronically stalk or otherwise harass another user;
  • Engage in any activities that would violate the personal privacy rights of others, including but not limited to collecting and distributing information about other users without their permission, except as permitted by applicable law;
  • Use the Web site for any illegal purpose, or violate any applicable local, state, national, foreign or international law or regulation, intentionally or unintentionally;
  • Use any community areas to buy or solicit any goods, services, or money to advertise or sell products or services of others;
  • Post on behalf of a banned member, or you may also be banned without notice or warning.
  • Post, disseminate, or transmit any content that includes or promotes discussion about reimbursement in any way;
  • Post in a language other than English.

Violations of these Guidelines

If you violate these User Conduct Guidelines, community staff will contact you. Your actions may result in a warning, suspension, or permanent banning from participation in the community. If you see a message you believe violates our guidelines please use the “alert” function available in the “reply” menu, or contact us.

User Content

You acknowledge that although the community staff does not generally prescreen Content, community staff and their designees have the right (but not the obligation) in their sole discretion to edit, refuse, remove, or move any Content that violates the Web site’s Legal Notice or these User Guidelines or that the community staff considers, in its sole discretion, objectionable, whether for legal or for other reasons. You understand that the technical processing and transmission of the Web site, including your Content, may involve transmissions over various networks and require changes to conform and adapt to technical requirements of connecting networks or devices. You acknowledge and agree that the Johnson & Johnson Diabetes Institute Community may preserve Content and may also disclose Content if required to do so by law or in the good faith belief that such preservation or disclosure is reasonably necessary to (a) comply with legal process; (b) enforce these guidelines; (c) respond to claims that any Content violates the rights of third parties; or (d) protect the rights, property, or personal safety of the Johnson & Johnson Diabetes Institute Community, its users, and the public. By posting Content to the Web site or by transmitting Content using the Web site, you (1) represent and warrant that you have obtained all necessary licenses, consents, waivers, releases, authorizations and/or permissions to post or transmit Content; and (2) grant to the Johnson & Johnson Diabetes Institute, LLC an irrevocable, worldwide, nonexclusive, perpetual, fully sub-licensable, royalty-free right and license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, transmit, publicly perform, and publicly display such Content (in whole or part) and/or to incorporate it (in whole or in part) in other works in any form, media, or technology now known or later developed.

You acknowledge that the Johnson & Johnson Diabetes Institute Community contains the opinions and views of other users. You acknowledge further that the Johnson & Johnson Diabetes Institute, LLC is not responsible for the accuracy of any user messages on the Web site. You understand and agree that you will evaluate, and bear all risks associated with, the use of any Content, including any reliance on the accuracy, completeness, or usefulness of such Content.

You acknowledge and agree that, beyond providing and facilitating the message board, the Johnson & Johnson Diabetes Institute, LLC has no control over or oversight of, and will not participate or otherwise be involved in, your dealings with any other users. Any outside communications, transactions or other dealings that you may have or enter into with any other user of the message board are solely between you and such other user.

You agree that the Johnson & Johnson Diabetes Institute, LLC may establish, in its sole discretion and without prior notice to you, a maximum amount of storage space for Content maintained, disseminated, or transmitted through the Web site. You agree that the Johnson & Johnson Diabetes Institute, LLC has no responsibility or liability for the deletion of or failure to store any messages, communications, or other Content maintained, disseminated, or transmitted through the Web site.

Although the content of the Johnson & Johnson Diabetes Institute Community is monitored, neither this site nor its monitors assumes any responsibility for the privacy of any information you provide in such area.
